I, James Swan Sr of CC, am in sound and perfect memory.
To my 4 brothers, John, William, Justinian, and George - all my moveable estate, to be equally divided between them, except my wearing apparel, saddle, and bridle, which I give to my brother John.
All the debts that are due me on my books, by bond, note, or open acct, shall be collected, and after my just debts are paid, to be lodged in good hands, at interest, for the use of repairing of Allens Fresh Mills when wanting, as far as that money will go.
To my brother George Swan - the debt he owes me besides the share of what he is to share with my other brothers.
To James Duncan - 100 acres of land from a tract of land of mine lying on Brashearses Cr in the Kentucky Settlement, during his natural life, for him to live on.
To my 3 brothers, William, Justinian, and George Swan - the use of all my back lands, during their natural lives, to be equally divided between them, and after their death, to the heirs of [their] body lawfully begotten; if neither of my brothers shall leave lawful issue, then to my kinsman, Samuel Theobalds.
To my brother William Swan - one half of the neat profits of Allens Fresh Mills paid to him yearly during his natural life, to support him in victuals and clothes and William has no right or title to sell any donation to him to any person. My intention is for it to be a support to him in his old age. If he offers my donation for sale, then my executors are to stop payment, and lay out the money on him, sd Wiliam, to the best advantage they shall think fit, for his profit. If William marries and has lawful issue, then after the death of my other brothers, William's heirs to enjoy the afd mills. If William dies without lawful issue, then to the nex[t] heirs of my brothers. If all my brothers die without issue, to go to my kinsman, Samuel Theobalds and his heirs.
The other half of the profits of Allens Fresh Mills to be divided between my other 3 brothers.

"Chas Co Crt, Nov Term, 1820. Peter Gough & Co, vs Jas Swann, Fred'k Haymaker & Mary his wife, John Elder & Sarah his wife, Rebecca Swann, Justinian Swann, David Stem & Eliz his wife. Ratify sale of land whereof Wm Swann died seized; sold by the trustee, H. Brawner, on Oct. 4 last; 100 acs sold for $7.56 1/4 cts per ac. - John Barnes, clk" (source: Daily National Intelligencer, Jan 27, 1821, submitted by K. Torp to [genealogytrails.com]).

"In the December, 1860 term of the Maryland Court of Appeals: David Stem and wife vs Samuel Cox, and others. Appeal from the Equity side of the Circuit Court for Charles County. The bill in this case, filed on the 1st of April 1857, by the appellants, on behalf of themselves and the other heirs of William Swann, deceased, against J.H. Hanson, the administrators of Hugh Cox ... alleges that William Swann died in 1821, leaving six children his heirs-at-law... "

The document goes on to show that James Swann was the eldest son of William Swann and James "elected to take the valuation of the commissioners and on 27 March 1823, he gave bond to the state for payment to the other heirs of their proportions of this valuation..." Subsequently James died, leaving two sons, George and James, his heirs, both of whom had died intestate, without issue and without property, by the time the appeal was filed. On 31 July, 1858, the court dismissed the bill, which then resulted in the appeal document. The appeal was denied.

1777 - Revolutionary War Service. Jesse Swann was a private in Capt. John Mills' Company in the Upper Battalion of St. Mary's Co. troops in the Maryland Militia. This Company was to guard the coast in the lower part of the county.
